Terms and Conditions

  1. Applicability

    1. These Terms and Conditions apply to all offers from Lock Works and to all agreements concluded with Lock Works. Lock Works is a brand of Quality Works B.V. and is sold by Distri Works B.V. in Lelystad, registered with the Dutch Chamber of Commerce under number 92297986.
    2. In addition to these Terms and Conditions, Additional Terms may apply to specific services and/or products when explicitly stated. If any differences exist between the Additional Terms and these Terms and Conditions, the provisions of the Additional Terms shall prevail unless otherwise specified.
    3. Deviations from these Terms and Conditions are only valid if agreed upon explicitly and in writing, and in such cases the remaining provisions of these Terms and Conditions remain fully applicable.
    4. If the Buyer refers to their own general terms and conditions, these shall not apply unless Lock Works has explicitly agreed to them in writing.
    5. The Lock Works website is aimed at the Netherlands and the European Union.
    6. The term “Buyer” refers to any visitor of the website or any natural or legal person who has or enters into a contractual relationship of any kind with Lock Works.
    7. Lock Works reserves the right to modify or supplement these Terms and Conditions at any time.
    8. By using the Lock Works website and/or placing an order, the Buyer accepts these Terms and Conditions as well as all other rights and obligations as stated on the website.
    9. Lock Works is authorized to engage third parties for the execution of any agreement with the Buyer.
  2. Offers and Formation of Agreements

    1. Offers or price quotations must be regarded as an invitation to potential Buyers to make an offer. Lock Works is in no way bound to such offers unless explicitly and unambiguously confirmed in writing. Acceptance of the invitation to make an offer by the potential Buyer counts as an offer and only leads to the formation of an agreement if the conditions of this article are met.
    2. Offers are valid while stocks last.
    3. A personalised quotation is valid for two (2) weeks unless stated otherwise.
    4. An offer made by the potential Buyer as described in article 2.1 is deemed to have been made in the following situations:
      • the potential Buyer has clearly indicated which product and/or service they wish to receive;
      • a quotation has been signed by the Buyer and received by Lock Works when such a quotation was issued by Lock Works;
      • the potential Buyer has entered information on the website’s order form and the submitted data has been received electronically by Lock Works.
    5. An agreement is formed at the moment the order confirmation is handed to the Buyer or, in the case of an online order, sent to the Buyer’s email address. Lock Works reserves the right to refuse any order.
    6. The Buyer and Lock Works explicitly agree that electronic communication forms a valid agreement as soon as the conditions in articles 2.4 and 2.5 are met. The absence of a physical signature does not affect the binding nature of the agreement. Electronic files of Lock Works serve—where legally permitted—as evidence.
    7. Information, images, oral communications, telephone communications, email, and data regarding all offers and key characteristics of products are provided as accurately as possible. Lock Works does not guarantee that all products fully correspond to the provided information. Deviations may not be grounds for compensation and/or termination.
  3. Prices

    1. All prices are expressed in Euros in accordance with legal requirements and include VAT unless otherwise stated.
    2. Special offers are valid only for the period stated with that offer, either in advertisements or on the website.
    3. The Buyer owes the price stated by Lock Works in the order confirmation as referred to in article 2.5. Obvious (manipulation) errors, such as clear inaccuracies, may be corrected even after the agreement has been formed.
    4. Shipping costs are not included in the price. Shipping rates are listed on the website. Special rates apply to deliveries outside the Netherlands. Certain payment methods may require specific shipping methods and associated costs, which will be clearly communicated. Return shipping costs are always borne by the Buyer.
    5. Lock Works may be required to collect certain statutory fees on its products, such as disposal contributions. These are not included in the price and will be clearly listed on the website.
    6. For deliveries outside the European Union, VAT is automatically removed at checkout, except for orders to Norway that fall under the VOEC scheme.
    7. For deliveries to Norway, we collect Norwegian VAT under the VOEC scheme for products valued up to 3,000 NOK per item. This prevents you from paying VAT upon delivery. Import duties or fees outside the VOEC scheme remain the Buyer’s responsibility.
  4. Payment

    1. For online orders, payment can be made in the following ways:
      • Bank transfer
      • Any methods offered on our website
      Lock Works may expand available payment methods in the future. Any additional methods will be listed on the website.
    2. Cash-on-delivery (COD) payments may be allowed upon request but incur extra charges. Orders above €1,000 cannot be shipped COD.
    3. Other payment methods may only be used if the conditions of those methods are met, such as credit checks, authentication, and authorization.
    4. If a payment term has been agreed, the Buyer is in default merely by exceeding that term. Payment terms must always be agreed in writing.
    5. If the Buyer fails to pay on time, interest of 1.5% per month is charged on the outstanding amount, where a started month counts as a full month.
    6. All judicial and extrajudicial costs incurred by Lock Works due to the Buyer’s failure to comply with payment obligations shall be borne by the Buyer.
    7. In the event of late payment, Lock Works may terminate the agreement immediately or suspend (further) delivery until all outstanding amounts, including interest and costs, have been paid.
  5. Delivery and Delivery Time

    1. Orders are delivered as quickly as possible. Lock Works aims to dispatch orders placed before 16:00 on business days the same day. Delivery times are indicative only and never binding.
    2. If a product is temporarily out of stock, the Buyer will be informed when it becomes available again. Any delays will be communicated by email or phone.
    3. Deliveries take place at the address provided during checkout. For payment methods such as credit cards or PayPal, Lock Works must comply with the location requirements of those providers, and this will be communicated in advance.
    4. Once the products have been delivered to the specified address, the risk transfers to the Buyer.
    5. Different conditions may apply to international deliveries.
    6. For deliveries outside the EU, import duties, local VAT, and administrative fees may apply. These are always the Buyer’s responsibility.
    7. Returns from outside the EU are at the Buyer’s expense. Clearly label the package as a return to avoid customs charges upon re-entry to the Netherlands.
    8. Lock Works may refuse orders if delivery to certain countries is not possible or not advisable.
  6. Right of Withdrawal

    1. You have the right to withdraw from the agreement within 14 days without providing any reason. The withdrawal period ends 14 days after the day on which you, or a third party designated by you who is not the carrier, physically receives the product.
    2. To exercise the right of withdrawal, you must inform us (Lock Works) with an unambiguous statement (e.g., by email or post).
    3. You may use our online return request, but this is not required. See: https://www.lock.works/index.php?route=account/return/add.
    4. To meet the withdrawal deadline, it is sufficient to send your withdrawal notice before the 14-day period has expired.
    5. Effects of Withdrawal

      1. If you withdraw, we will refund all payments received from you, including standard delivery costs (excluding supplementary costs resulting from your choice of a shipping method other than the cheapest standard delivery) within 14 days after notification.
      2. Refunds will be made using the same payment method you used unless you expressly agree otherwise.
      3. We may withhold the refund until we have received the goods, or until you have supplied proof of return, whichever is earliest.
      4. You must return the goods without delay and no later than 14 days after receipt.
      5. The direct costs of returning the goods are your responsibility.
      6. You are liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the product.
    6. Return Conditions and Depreciation

      1. You may inspect the product as you would in a physical store. Use beyond this may result in depreciation.
      2. Installation

        1. Installing Guardian on your motorcycle is always considered use.
        2. Installation typically leaves minor marks where bolts are tightened.
        3. Installation therefore always results in depreciation when returned.
      3. Depreciation may apply in situations such as:
        • visible installation or usage marks
        • damaged or missing spacers
        • damaged or missing DustPlug
        • opened or damaged key set or Security Card
        • damaged or missing packaging or internal materials
        • damage caused by incorrect use or faulty installation
        • incomplete returns
        • contamination, oil, or grease traces
      4. A return may be refused if the product is used or damaged to the extent that it can no longer be resold. In such cases, the product will be returned to you.
      5. Return the product complete, clean, and preferably in its original packaging.
  7. Exclusions from the Right of Withdrawal

    1. All current Lock Works products are fully covered by the right of withdrawal.
    2. Exclusions are only applied when explicitly permitted by law.
    3. If we introduce custom-made products or products that cannot be returned for health or hygiene reasons once opened, the right of withdrawal will not apply to those items.
    4. Any such exclusions will always be clearly indicated on the product page.
  8. Warranty and Liability

    1. You are entitled to statutory warranty. A product must perform as you may reasonably expect.
    2. Guardian carries a lifetime warranty against material and manufacturing defects for all components, including the LockPin, spacers, and DustPlug.
    3. The warranty applies only under normal use and correct maintenance.
    4. The warranty does not apply in cases of:
      • incorrect installation
      • incorrect spacer selection
      • use of oil or unsuitable maintenance products
      • impact or crash damage
      • modifications or non-original parts
      • contamination, corrosion, or poor maintenance
      • installation on a non-compatible motorcycle
    5. You are responsible for correct installation according to the manual, even if performed by third parties.
    6. Lock Works is not liable for damage resulting from incorrect installation, incorrect spacer choice, misuse, or modifications.
    7. Lock Works is not liable for consequential damage, labour costs, transport costs, or lost income.
    8. Lock Works is only liable in cases of intent or gross negligence.
  9. Privacy

    1. We process your personal data according to our privacy policy, which is available on our website.
  10. Dispute Resolution

    1. The European Commission provides an online dispute resolution platform, available at: http://ec.europa.eu/consumers/odr/. Consumers may use this platform to resolve disputes.
